Conspiring to get pardons

Frank Rich:

Judge Walton's greatest move was not the 30-month sentence he gave Mr. Libby, a fall guy for higher-ups (and certain to be pardoned to protect their secrets).

Hmm. One thing you have to take into account with this is that conspiring to pardon Lewis Libby so that he should keep secrets would be prosecutable obstruction of justice (and therefore, in a better world, an obviously impeachable Whitehousesquattorial offense). The ‘safest’ way to pardon Libby would be to do it when the whole country had the opportunity, at long last, not to hear anymore about George W. Bush, and even then it might not be enough, because there is something like a 5-year statute of limitations and there is Patrick Fitzgerald keeping an eye on things.
