After Bush commuted Lewis Libby’s sentence, the Internet has gone wild with the explanation that a pardon would have eliminated Libby’s ability to ‘take the Fifth’. No longer would he be incriminating himself if he talked about the crimes for which he had been pardoned.

I feel like Cassandra, because I’ve been blogging, blog-commenting, and email-to-bloggering about this constraint on pardon-giving for, I don’t know, how long is it now?

I really don’t understand why this point didn’t attract more attention earlier, because it is so simple, at least insofar as technical legal dilemmas can be simple.

Obama, good for the Supreme Court

Not too many days ago David Bender on Air America Radio was discussing Barack Obama with someone, and the gist of it was that Barack Obama seemed a very cautious person of a sort that would make a good Supreme Court Justice, but not a good President.
